      按照规制理论,引入第三方评估实现了政府部门与专业机构的“合作规制”,由此教育管 办评各方之间的权利义务关系发生了变化,第三方评估机构在独立开展评估活动、形成评估结果 过程中形成的专业权力是引发变化的主要因素。如何规范第三方机构与行政部门的法律关系,对 第三方机构的评估活动依法实施监督,为评估对象创设必要的行政法律救济途径,是当前教育领 域引入第三方评估基础性规范建设面临的紧迫任务。
英文摘要:
      According to regulation theory, introduction of third-party evaluation realizes “regulation” of cooperation between government departments and professional institutions. As a result, the relationship between the rights and obligations of related parties has changed. The professional power generated by third-party evaluation institutions in the process of independently carrying out evaluation activities and forming evaluation results is the main factor. How to regulate the legal relationship between the third-party institutions and the administrative departments, how to supervise the evaluation activities of the third-party institutions according to law, and how to create the necessary administrative legal relief channels for evaluation objects are the urgent tasks faced by the basic standard construction of third-party evaluation in the field of education.
